  • You will not use ZonkHost’s services to resell or provide any of ZonkHost’s services to any third party without ZonkHost’s prior written consent.
  • You will not use ZonkHost’s services to interfere with the operation of ZonkHost’s servers or networks.
  • You will not use ZonkHost’s services to access or store any confidential or sensitive information without the consent of the owner of the information.
  • You will not use ZonkHost’s services to store any data that is more than 100 GB in size.
  • You will not use ZonkHost’s services to store any data that is illegal or harmful.

Examples of Prohibited Activities

To maintain this environment, we ask that you refrain from engaging in any activities that could harm or disrupt our services or the experience of other users. Here are some specific examples of prohibited activities:

  • Violating Laws and Regulations: Do not use ZonkHost’s services to engage in any activity that violates applicable laws or regulations. This includes activities such as copyright infringement, trademark infringement, and distribution of illegal content.
  • Transmitting or Storing Harmful Material: Refrain from transmitting or storing any material that could cause harm or offense to others. This includes material that is:
    • Harmful: Any content that could cause physical or emotional harm to others, such as malware or viruses.
    • Obscene: Any content that is sexually explicit or violent in nature.
    • Illegal: Any content that violates the law, such as child pornography or pirated software.

  • Launching Attacks on Other Systems: Refrain from using ZonkHost’s services to launch attacks on other computer systems or networks. This includes activities such as hacking, denial-of-service attacks, and other forms of cyberattacks.
  • Reselling or Providing Services: Do not resell or provide any of ZonkHost’s services to any third party without our prior written consent. This includes activities such as subletting hosting accounts or offering hosting services under your own name.
  • Interfering with Server Operations: Refrain from taking any actions that could interfere with the operation of ZonkHost’s servers or networks. This includes activities such as overloading servers, attempting to gain unauthorized access, or intentionally introducing errors.
  • Accessing Confidential Information: Do not use ZonkHost’s services to access or store any confidential or sensitive information without the consent of the owner of the information. This includes activities such as accessing personal data, financial information, or trade secrets without authorization.
  • Storing Excessive Data: Refrain from storing more than 100 GB of data on your ZonkHost account. This is to ensure that our services remain available to all users and to prevent excessive strain on our infrastructure.
  • Storing Illegal or Harmful Data: Do not use ZonkHost’s services to store any data that is illegal or harmful. This includes data that could cause harm to others, violate laws, or infringe on intellectual property rights.

3. ZonkHost’s Obligations

ZonkHost agrees to the following:

  • ZonkHost will provide you with the Services in accordance with these Terms.
  • ZonkHost will use its commercially reasonable efforts to protect your Account and Content from unauthorized access.
  • ZonkHost will not disclose your Content to any third party without your consent, except as required by law or as otherwise set forth in these Terms.
  • ZonkHost will not use your Content for any purpose other than providing you with the Services.

4. Intellectual Property

ZonkHost owns all right, title, and interest in and to the Services, including all intellectual property rights therein. You agree not to copy, modify, or create derivative works of the Services without ZonkHost’s prior written consent.

5. Termination

ZonkHost may terminate your Account at any time, for any reason or no reason. If ZonkHost terminates your Account for violation of these Terms, you will be responsible for paying all outstanding fees for the Services.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ZONKHOST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

ZONKHOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ZONKHOST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ZONKHOST’S LIABILITY EXCEED THE AMOUNT OF FEES PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

8. Indemnification

You agree to indemnify, defend, and hold harmless ZonkHost, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any law or regulation.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
